So my grandpa flipped out and declared that this all may be illegal and send me to prison for life ._>

can someone explain to me the legality standpoint of brawl "hacking"?

I don't think it's illegal because we are editing our own property. Once we purchase the game, we are free to do with it as we please, like break the game disc. Granted why you would buy a game just to break it is beyond me but it proves the point. We aren't causing any harm just editing stuff in the game. If this was illegal, the creators of Gamesharks, Action Replays, and Game Genies would be sued immensely.

I think of it as:

"Hey, we bought the game, so we have the right to do what the heck we want with it."

You dont buy a cheeseburger, and the person selling it cant say you cant put ketchup on it.

It's modifying copyrighted files, which is technically illegal, but isn't wrong.  Also, I extremely doubt that anybody would bother prosecuting a Brawl hacker over the millions of other hackers , especially pirates (piracy actually IS stealing, we're just messing with stuff we bought). In the end, we're not harming Nintendo in any way, in fact, we're probably encouraging people to buy Brawl so they can hack it.  

But if they minded, they would have taken action by now.

Nobody's gotten in trouble for Brawl hacking (Syntax Error got shut down by Wordpress, NOT Nintendo).  Wordpress was afraid that Nintendo would do something, but we don't even know if Nintendo knew about them then or now.  We do know however that they haven't tried to stop us specifically (they've tried to stop Homebrew in general, but that's because of piracy).

I agree with STUFF2o. But it really depends on how you look at it.

Anyways, your grandpa is old and shouldn't be questioning the legality of hacking brawl. If you get sent to prison I'll go there right along with you man.

Anybody who thinks it's a good idea to arrest a Brawl hacker is an imbecile.  They could be spending their time arresting people who actually hurt people in some way.  Thankfully, I don't know of anybody that stupid.

Its kinda funny how were getting to make games just as good as they can (or better). Mewtwo2000's stages, mariokart64n's models,  johnlcb's textures, etc.

It's definitely illegal to distribute hacks for money, but I'm not sure about what we do here.  In any case, there's no way you'd get sent to jail for distributing intellectual property.  Just sued/fined (not that that'll happen either).

Action Replay and its ilk work by modifying RAM, not by directly altering proprietary files like we do.

You has made my brain have an idea...Ima send pics of hacked characters, stages, etc to IGN's Chris HArris telling him that its fan art and we'll see if he publishes them somewhere xDDDDD

I'm guessing you don't actually know anything about how ARs work.

It's still memory modification, not changing any of the game's internal files.

Well, here's how I stand on this. It may me illegal, it may not, I don't know. But, if you think that nintendo cares, they would've followed suit, and they haven't. And they won't, nintendo  probably knows that with the whole viacom and youtube, people have most likely stopped buying there products. And, that the same would happen with nintendo. If they sued, nobody would but there games anymore. I mean, they hate it when people post ROMs of their games, yet they haven't filed suit. Why? Cause nintendo knows they would lose a lot of fans if they followed suit. So I don't think nintendo really cares about us hacking. So let's keep hacking!!!!!!!!!

Whether Nintendo cares or not has nothing to do with legality.

We decrypt and modify Nintendo's proprietary files using programs from or based on the proprietary Nintendo Revolution Software Development Kit without permission from Nintendo. What we are doing is illegal; there's no way around it.

But unless Nintendo presses charges -- and they won't do that, because they don't care -- we won't get in trouble for it.

they would only attack the forum owner to cease operation of the site. worst case scenario, they may demand the SQL database of this forum. which would hand them over our IPs and emails... but they would have to pull jack into a court battle for that.. highly unlikely..

but no where in the history of videogame modding, has any company sued individual members of a hacking or warez site.

so users on the forum are 100% safe, the staff here on the other hand are not.

Conclusion:
Illegal: Yes
Risk: Low

they actually have sued mod chip makers, and have gone after alot of homebrew makers. typically who have created debuggers for cheating, and playing backups.

I haven't heard of a case where nintendo has attacked a warez share site, but nintendo has taken legal action over the wii..

just saying, nobody can say what nintendo will, and won't do.

Nintendo doesn't want your money; there's no way a normal person could ever pay the amounts they ask for. They sue to make an example of you and to make you stop whatever it is you're doing.

If Nintendo tries to sue us each, and I suspect there are hundreds if not thousands of brawl hackers out there, the legal papers and lawyer fees alone would probably give them about an
extremely low amount of money, or even result in the losing money, not to mention they would lose all these people as Nintendo fans, and hopefully promoters.

You aren't buying a cheeseburger with copyright. The game is copyrighted, so technically nintendo still owns everything inside the disk. By sharing anything inside the disk modified or not is illegal. But who cares, i don't think nintendo cares all too much, its keeping their game alive.

After the game having alot of bugs, unfinished files, slightly disappointing roster and stupid unlockables no one really cares about, not to mention the 4353465677 delays they made us wait through.....and the tripping...I'd say to the people at nintendo.

With the small exception that, you know, they're legal for it, they're emulating many of the games we loved and cherished.
