There's only been one Project M demo available, which is where those two got their stuff from.

Adding on to that.
Both Mario and Ganon are in the released Project M demo, meaning that it's OK if people use stuff from them.
Wario wasn't included in the Project M demo, but was leaked from a backroom build of Project M, meaning he wasn't released and therefor it's NOT OK to have any of his stuff used and publicly released before Wario is included in a official release of Project M.
