Wouldn't be surprised if he does or doesn't but either way, we'll still have to wait a year or more after the game gets released for someone to crack down on the files. I honestly don't see Nintendo just using Brawl's engine and files for the game.

all of his Normal attacks is done
only Specials/throw/FS

and FS will kinda still be Brawl mario´s but instead of afew fireballs it will be one big needle
and will oneshot anyone around 30-40% dmg (if on a stage as small as FD stage)
also will change the animetions for throw it but it is basely the same
